Arizona contractors
What a contract over $1,000 has to say
This is a plain-language checklist of A.R.S. § 32-1158. It is not legal advice, and it is not a form from the Arizona Registrar of Contractors. Read the statute and current ROC guidance before you rely on a contract.
A.R.S. § 32-1158 applies to a contract of more than $1,000 between a contractor and the owner of property to be improved. The statute says the contract shall contain, in writing, at least the following:
- The contractor's name, business address, and license number.
- The owner's name and mailing address, and the jobsite address or legal description.
- The date the parties entered into the contract.
- The estimated date of completion of all work under the contract.
- A description of the work to be performed.
- The total dollar amount to be paid, including all applicable taxes.
- The dollar amount of any advance deposit paid or scheduled.
- The dollar amount of any progress payment and the stage of construction when it is due.
- A prominent notice, in at least 10-point bold type, that the owner may file a written complaint with the Registrar of Contractors for an alleged violation of A.R.S. § 32-1154(A). The contract must include the Registrar's telephone number and website, and state that complaints must be made within the time in A.R.S. § 32-1162(A). The owner and the contractor, or the contractor's designated representative, sign the contract. This notice does not apply to a person who is subject to and complies with A.R.S. § 12-1365.
Copy and receipt
When the contractor and the owner sign, the contractor must give the owner a legible copy of every signed document and a written, signed receipt for the true amount of any cash paid.
The statute also says these requirements are not prerequisites to forming or enforcing a contract. Failing to include them is not, by itself, a defense to a claim for compensation, damages, breach, or enforcement.
Complaint deadline
A.R.S. § 32-1155(A) says a written complaint must be filed within the time limit in A.R.S. § 32-1162. Section 32-1162(A) says the complaint must be filed:
- For new home builds or other new building construction, within two years after the earlier of the close of escrow or actual occupancy.
- For all other projects, within two years after the completion of the specific project.
